These Terms and Conditions govern all purchases made through the above-mentioned websites.

Article 2 – Subject Matter of the Contract

These Terms and Conditions govern the distance sale, through the ONYTCG websites, of products intended for collecting, gaming and hobby purposes.

By way of example, and without limitation, the products offered for sale may include:

Trading Card Games (TCG) and collectible cards;
single cards;
booster packs;
booster boxes, displays, bundles and Elite Trainer Boxes (ETBs);
starter decks, structure decks and other sealed products;
accessories for trading card games;
binders, albums, deck boxes, card sleeves, playmats and other gaming accessories;
collectible items;
figures, merchandise and related products;
any other products offered for sale by ONYTCG and available on the Website.

The above list is provided for illustrative purposes only and does not limit the categories of products that may be offered for sale on the Website.

Article 3 – Acceptance of the Terms and Conditions

By submitting an order, the Customer acknowledges that they have read, understood and fully accepted these Terms and Conditions of Sale, Returns and Withdrawal, as well as any other policies referred to herein, including, where applicable, the Privacy Policy.

The submission of an order constitutes a contractual offer to purchase the selected products and is subject to the acceptance of these Terms and Conditions.

Article 4 – Eligible Purchasers

The following parties may purchase products through the Website:

consumers;
professionals;
businesses, companies and organizations;
resellers, where expressly authorized by the Seller.

Pursuant to Article 3 of the Italian Consumer Code (Legislative Decree No. 206/2005), a consumer is any natural person acting for purposes outside their trade, business, craft or profession.

A professional is any natural or legal person acting for purposes relating to their trade, business, craft or profession.

The Seller reserves the right to refuse or cancel orders placed by resellers or other commercial operators where prior authorization has not been granted or in the cases provided for under these Terms and Conditions.

Article 5 – Conclusion of the Contract

The submission of an order by the Customer constitutes an offer to purchase the selected products.

The sales contract shall be deemed concluded when the Customer receives the order confirmation from ONYTCG by email or another durable medium.

Any automatic acknowledgment of receipt of the order merely confirms that the order has been successfully received by the system and does not constitute final acceptance in cases of product unavailability, technical errors, pricing errors, administrative checks or any other circumstances preventing the proper performance of the contract.

The Seller reserves the right to refuse, cancel or suspend an order, including but not limited to, the following circumstances:

incomplete, inaccurate or unverifiable Customer information;
failed, delayed or unsuccessful payment;
suspected fraud or unauthorized use of payment methods;
clerical or technical errors relating to the price, description or availability of a product;
total or partial unavailability of the ordered products;
abusive, fraudulent or bad-faith conduct by the Customer.

Where payment has already been made, ONYTCG will refund any amounts received without undue delay using the same payment method used for the original transaction, unless otherwise agreed with the Customer.

Article 6 – Prices

All product prices are expressed in Euro (€) unless otherwise stated and are those displayed on the Website at the time the order is submitted.

Unless otherwise specified, prices include VAT where applicable under current legislation. Any shipping costs, taxes, customs duties or other additional charges, where applicable, will be clearly indicated during the checkout process.

The Seller reserves the right to change product prices at any time without prior notice. Such changes shall not affect orders that have already been confirmed, for which the price displayed at the time the order was submitted shall apply.

If, due to a clerical, technical or system error, a product is displayed at a manifestly incorrect, abnormal or negligible price compared to its actual value, the Seller reserves the right to cancel the order, promptly inform the Customer and issue a full refund of any amounts already paid.

Article 7 – Product Availability

The availability of products displayed on the Website is provided for informational purposes only and does not constitute a guarantee that the products will be available at the time the order is processed.

Due to simultaneous sales, inventory updates, technical errors, system synchronization delays or other circumstances beyond the Seller's control, one or more products may become unavailable after the order has been placed.

If an ordered product becomes wholly or partially unavailable, ONYTCG will promptly inform the Customer, who may choose, where applicable, one of the following options:

a full or partial refund of the amount paid;
replacement with an equivalent product, subject to the Customer's agreement;
waiting for the product to be restocked, where applicable;
the voluntary issuance of a Store Credit of equivalent value.

Acceptance of a Store Credit is entirely optional and does not affect the Customer's right to receive a refund in accordance with applicable law.

Article 8 – Pre-Orders

Certain products may be offered for sale on a pre-order basis.

Release dates, shipping dates and product availability communicated by publishers, manufacturers, distributors or other suppliers are provided for informational purposes only and may be changed without prior notice. ONYTCG shall not be liable for official postponements, production delays, logistical delays or any other circumstances beyond the Seller's reasonable control.

The availability of pre-order products may be subject to allocations or quantity limitations imposed by manufacturers, distributors or suppliers.

If the quantity allocated to ONYTCG is lower than the quantity ordered by Customers, ONYTCG reserves the right to:

reduce the quantity allocated to each Customer;
fulfill orders according to objective criteria, including, by way of example, the chronological order in which orders were received;
offer a full or partial refund;
with the Customer's prior consent, offer a Store Credit or an alternative product of equivalent value.

Placing a pre-order does not guarantee product availability where the manufacturer, distributor or supplier imposes allocation limits or other supply restrictions.

Article 9 – Collectible Cards and Sealed Products

Collectible cards and sealed products may exhibit characteristics resulting from the normal manufacturing process, including, but not limited to:

minor printing imperfections;
slight surface marks;
centering imperfections;
slight factory warping or bending;
minor variations in cutting, finishing or color;
other manufacturing tolerances generally accepted within the industry.

Where such characteristics comply with the manufacturer's quality standards, they shall not be considered defects or lack of conformity.

Product images displayed on the Website are provided for illustrative purposes only, unless expressly stated otherwise to indicate that actual photographs or scans of the product are being shown.

The random contents of booster packs, booster boxes, displays, bundles, starter decks or any other sealed products are determined solely by the manufacturer. ONYTCG does not guarantee the inclusion of specific cards, rarities, pull rates, serial numbers, product contents or any particular results obtained from opening sealed products.

Any subjective assessment regarding a card's condition, grading potential or collectible value shall not constitute valid grounds for withdrawal, return or complaint, except where otherwise provided by applicable law concerning lack of conformity.

Article 10 – Payment Methods

ONYTCG offers the payment methods displayed during the checkout process. The available payment methods may change over time and are those shown at the time the order is placed.

By way of example, Customers may choose from the following payment methods:

PayPal;
credit and debit cards;
Stripe;
bank transfer;
Scalapay;
any other payment methods made available on the Website.

The Seller reserves the right to add, modify or remove available payment methods at any time.

Orders will be processed and shipped only after payment has been successfully confirmed, except where the selected payment method provides for immediate authorization or different processing conditions.

For payments made by bank transfer, the order will be processed only after the funds have been credited to the Seller's bank account, unless otherwise agreed.

If a payment is declined, cancelled or not authorized by the payment provider, the order cannot be accepted or fulfilled.

Article 11 – Gift Cards and Store Credit

ONYTCG offers digital Gift Cards and Store Credit that may be used for purchases made through the official ONYTCG websites, unless otherwise specified.

Gift Cards are issued exclusively in digital format and are delivered to the email address provided by the Customer. No physical product will be shipped.

Gift Cards and Store Credit may be used to purchase both in-stock products and pre-order products, unless otherwise stated on the relevant product page.

The available balance may be used across one or more orders until the full value has been exhausted.

Unless otherwise specified at the time of issue, Gift Cards and Store Credit do not expire.

Any remaining balance will remain available for future purchases.

Gift Cards and Store Credit are not redeemable for cash, except where required by applicable law.

The remaining balance can be viewed by logging into the Customer Account and accessing the "My Credit" section.

Article 12 – Fraud Prevention Checks

In order to protect both the Customer and the Seller, certain orders may be subject to fraud prevention or administrative verification checks.

ONYTCG reserves the right to request additional information or documentation necessary to verify the Customer's identity, the legitimacy of the payment or the accuracy of the information provided.

If the verification process cannot be completed successfully, or if there are reasonable grounds to suspect fraud, unauthorized use of payment methods or other unlawful activities, the Seller reserves the right to suspend, refuse or cancel the order and, where applicable, refund any amounts already received.

Article 13 – Shipping and Delivery

ONYTCG ships orders within Italy and to the countries served by its delivery network, primarily using express couriers such as UPS, BRT, or other equivalent carriers selected by the Seller.

Shipping costs, estimated delivery times and any geographical restrictions are displayed during the checkout process before the order is completed.

Delivery times are estimates only and shall not be considered an essential term of the contract. Delays caused by carriers, manufacturers, customs authorities, force majeure or any other circumstances beyond ONYTCG's reasonable control shall not entitle the Customer to claim compensation, except where otherwise required by applicable law.

Upon delivery, the Customer is required to inspect the package and verify that both the packaging and the products are intact.

If the package shows visible damage, signs of tampering or other irregularities, the Customer must immediately report such issues to the carrier, preferably by signing the delivery receipt with a specific reservation, and notify ONYTCG within 48 hours of delivery by sending an email to info@onytcg.it, including, where possible, photographs of the package and its contents.

In accordance with applicable law, the risk of loss of or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.

Article 14 – Right of Withdrawal

Consumers residing within the European Economic Area (EEA) have the right to withdraw from the purchase contract within 14 days from the day on which they acquire physical possession of the goods, without giving any reason.

If an order consists of multiple items delivered separately, the 14-day withdrawal period shall begin on the day the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the last item.

To exercise the right of withdrawal, the consumer may choose one of the following methods:

use the dedicated digital function available in the Customer Account, under the "My Orders" section, by clicking the "Withdraw from this contract" button;
send an explicit request by email to info@onytcg.it;
send a written notice to the following address:

The notice must contain all the information necessary to identify the customer and the relevant order.

Where the right of withdrawal is exercised through the digital "Withdraw from this contract" function, ONYTCG will provide the consumer, without undue delay, with an acknowledgment of receipt on a durable medium (for example, by email), indicating the date and time the request was submitted.

The exercise of the right of withdrawal does not affect any other rights granted to consumers under applicable law.

ONYTCG will provide customers with instructions for returning products.

Returned products must be:

intact
complete with all accessories
properly packaged
unused beyond what is necessary to inspect their nature and characteristics
accompanied, where possible, by the relevant order reference

For sealed products (including booster boxes, displays, starter decks, bundles and similar products), returns are accepted only if the product remains sealed and intact, except where opening was necessary to verify a lack of conformity or defect.

Article 15 – Return of Products

After receiving the withdrawal request, ONYTCG will provide the Customer with instructions for returning the products.

Unless otherwise agreed, the products must be returned within the time limits established by applicable law, properly packaged and in the condition required by law.

Returned products must:

be complete and undamaged;
include all accessories, manuals and components originally supplied;
be returned, where possible, in their original packaging or in packaging suitable to protect them during transport;
not have been used beyond what is necessary to establish their nature, characteristics and functioning;
where possible, include the order number or other order reference.

The Customer shall be liable for any diminished value of the returned goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning, in accordance with applicable law.

For sealed products (including, but not limited to, booster boxes, displays, starter decks, bundles and similar products), the right of withdrawal may only be exercised if the original seal remains fully intact, without prejudice to the Customer's statutory rights in the event of a lack of conformity or in any other cases provided for by applicable law.

ONYTCG reserves the right to inspect the condition of returned products before issuing any refund, in accordance with applicable law.

Article 16 – Exclusions from the Right of Withdrawal

The right of withdrawal is excluded in the cases provided for under Article 59 of the Italian Consumer Code (Legislative Decree No. 206/2005) and any other applicable legislation.

By way of example, and without limitation, the right of withdrawal may not be exercised in the following cases:

products that have been customized or manufactured according to the Customer's specifications;
sealed products that are not suitable for return due to health protection or hygiene reasons once unsealed after delivery, where provided by law;
sealed products for which applicable law excludes the right of withdrawal once the seal has been broken;
products returned incomplete, altered or damaged due to causes attributable to the Customer;
products that have been used beyond what is necessary to establish their nature, characteristics and functioning.

Nothing in this Article shall affect the Customer's statutory rights relating to the legal guarantee of conformity and remedies for lack of conformity under applicable law.

Article 17 – Return Shipping Costs

Unless otherwise required by applicable law or otherwise agreed in writing between the parties, the cost of returning the products shall be borne by the Customer.

Return shipping costs shall instead be borne by ONYTCG where the return is due to:

an error attributable to the Seller;
delivery of an incorrect product;
a defective or non-conforming product;
any other circumstance in which applicable law requires the Seller to bear such costs.

Customers are strongly advised to use a tracked shipping service when returning products.

ONYTCG shall not be liable for returned products that are lost, damaged or not delivered if the Customer has used an untracked shipping service or has failed to package the products appropriately.

Article 18 – Refunds

After receiving the returned products and verifying that they comply with the applicable return conditions, ONYTCG will process the refund within the time limits established by applicable law and, in any event, within 14 days from receipt of the withdrawal notice.

Pursuant to Article 56 of the Italian Consumer Code (Legislative Decree No. 206/2005), ONYTCG may withhold the refund until the returned goods have been received or until the Customer has provided satisfactory proof that the goods have been sent back, whichever occurs first.

Refunds will be made using the same payment method used by the Customer for the original transaction, unless the Customer has expressly agreed to a different refund method, provided that no additional costs are incurred by the Customer.

Where required by applicable law, the refund shall also include the cost of the standard delivery service originally paid by the Customer. Any additional costs arising from the Customer's choice of premium, express or optional delivery services shall not be refunded.

As an alternative to a refund through the original payment method, the Customer may voluntarily choose to receive an ONYTCG Store Credit or an ONYTCG Gift Card for an amount equal to the refund due.

Acceptance of a Store Credit or Gift Card is entirely optional and does not affect the Customer's statutory rights under applicable law.

Unless otherwise stated at the time of issue, ONYTCG Store Credit and Gift Cards do not have an expiration date.

If an order or pre-order is cancelled due to product unavailability, supplier allocations, manufacturer or distributor delays, or any other circumstance beyond ONYTCG's reasonable control, the Customer may choose between:

a refund to the original payment method; or
the issuance of an ONYTCG Store Credit of equivalent value.

Under no circumstances will a Store Credit be issued without the Customer's prior consent.

Article 19 – Legal Guarantee

Consumers are entitled to the legal guarantee of conformity provided for under applicable Italian and European legislation.

If a lack of conformity existing at the time of delivery is reported within the time limits established by law, the Customer shall be entitled, where applicable and in accordance with the relevant legislation, to one of the following remedies:

repair of the product;
replacement of the product;
an appropriate reduction in the purchase price;
termination of the contract with a full or partial refund, where applicable.

The statutory rights arising from the legal guarantee of conformity remain unaffected and are not limited by these Terms and Conditions.

Article 20 – Limitation of Liability

Except in cases of willful misconduct or gross negligence, and without prejudice to the mandatory rights granted to consumers under applicable law, ONYTCG shall not be liable for:

delivery delays attributable to carriers or other third parties;
force majeure events, unforeseen circumstances or other events beyond the Seller's reasonable control;
temporary interruptions or malfunctions of the Website, information systems or payment services;
indirect, consequential or incidental damages, loss of profits, loss of business opportunities or any damages not directly attributable to the Seller.

Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law.

Article 21 – Intellectual Property

All trademarks, logos, images, photographs, texts, product descriptions, graphics, videos and any other content available on the Website are the property of their respective owners or are used by ONYTCG under license, authorization or other lawful right.

Any reproduction, distribution, modification, publication or use, in whole or in part, of the Website's contents without the prior written consent of the respective rights holder is strictly prohibited, except where expressly permitted by applicable law.

Article 22 – Privacy

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), applicable national legislation and the Privacy Policy published on the Website.

For further information regarding the collection, processing, storage and protection of personal data, Customers are invited to consult the Privacy Policy available on the Website.

Article 23 – Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Italy.

Any dispute relating to the interpretation, validity or performance of a contract concluded with a consumer shall be subject to the jurisdiction of the court of the consumer's place of residence or domicile, where located within Italy, without prejudice to any rights granted under applicable European legislation.

Before initiating legal proceedings, Customers are invited to contact ONYTCG at info@onytcg.it in an effort to reach an amicable resolution.

Article 24 – Digital Withdrawal Function

ONYTCG provides consumers with a dedicated digital function for exercising their right of withdrawal, accessible through the Customer Account, under the "My Orders" section, via the "Withdraw from this contract" button.

This function allows consumers to submit their withdrawal request directly online in a simple and convenient manner.

Once the request has been submitted, ONYTCG will provide the consumer, without undue delay, with an acknowledgment of receipt on a durable medium (for example, by email), indicating the date and time the request was submitted.

The use of the digital "Withdraw from this contract" function constitutes an additional method of exercising the right of withdrawal and does not limit the consumer's right to exercise it by email or by any other means permitted under applicable law.
